Amicus Brief: In Re: Google Play Store Antitrust Litigation
In the case In Re: Google Play Store Antitrust Litigation, the District Court approved class certification. Google appealed this decision; subsequently, COSAL members filed a brief in support of affirming the Court’s ruling. Although Google stated that the Court did not give weight to their expert’s views, they did not need to address discrepancies between experts’ opinions at this time. As such, the Court’s analysis was sufficient to make a decision at the class certification stage. Class actions are a critical tool to combat the anticompetitive actions of large entities, such as Google. Allowing for such standards to certify a class would create even more obstacles for plaintiffs to stand out against monopolies. Therefore, COSAL argued that the Court should affirm certification, as this merit dispute imposed too high of a bar for early case stages and gave too much weight to the use of experts in antitrust cases.
